Terms, Delivery & Returns

About these terms

These terms apply to purchases made through the Andy Jenner Studio online shop. Andy Jenner Studio is operated jointly by Andrew Jenner and Diana Jenner, whose business and contact details can be found on our Legal Information page.

Orders and payment

When you place an order through our online shop, you will be asked to review your order and provide the information required to complete your purchase. Prices are shown in the currency displayed on the website at the time of purchase.

Payment is taken securely using the payment methods offered at checkout. An order is accepted when you receive confirmation that your order has been placed.

Production and fulfilment

Our products are created from our original photography and designs. We work with Printful, a professional print-on-demand production and fulfilment provider, to manufacture, package and dispatch products ordered through our online shop.

Because products are produced specifically in response to an order, production time is required before dispatch. Estimated delivery information is provided during the ordering process where available.

Delivery

Orders are dispatched to the delivery address provided at checkout. Delivery times vary depending on the product, destination and fulfilment location. Estimated delivery times shown during checkout are estimates and are not guaranteed delivery dates.

Delivery charges, where applicable, are shown before you complete your purchase.

If an order is delayed, lost or arrives damaged, please contact us at andyjenner62@hotmail.co.uk so that we can investigate and assist you.

Right of withdrawal and returns

Consumers may have a statutory right to withdraw from or cancel an online purchase under the consumer laws applicable to their purchase.

For consumers in the European Union, you generally have the right to withdraw from your purchase within 14 days of receiving your order, without giving a reason. Similar statutory cancellation rights may apply to consumers in other countries.

To exercise a statutory right of withdrawal or cancellation, please contact us at andyjenner62@hotmail.co.uk within the applicable period and clearly tell us that you wish to cancel your purchase.

For returns made under the EU right of withdrawal, goods must be returned without undue delay and no later than 14 days after you notify us of your decision to withdraw. Unless otherwise required by applicable law, you are responsible for the direct cost of returning the goods.

Please contact us before sending a return so that we can provide the appropriate return instructions. Change-of-mind returns should not be sent to our production partner.

Returned goods should be handled only as much as necessary to establish their nature, characteristics and functioning. You may be responsible for any reduction in value resulting from handling beyond what is necessary for this purpose.

Where a statutory right of withdrawal or cancellation applies, we will provide the refund required by applicable law. For EU consumers exercising the 14-day right of withdrawal, this includes the price paid and the cost of our standard delivery option. Additional delivery costs resulting from your choice of a more expensive delivery method are not refundable.

Nothing in these terms limits any mandatory consumer rights that apply to your purchase.

Damaged, defective or incorrect products

If your order arrives damaged, defective, misprinted or you receive an incorrect item, please contact us at andyjenner62@hotmail.co.uk as soon as possible. Please include your order details and, where possible, photographs clearly showing the problem and the packaging.

Please do not return a damaged, defective or incorrect item unless we ask you to do so. We will review the problem and provide instructions for the appropriate resolution.

Where applicable, we will arrange a replacement, refund or other remedy in accordance with your statutory consumer rights. You will not be required to bear return postage or other costs where the law requires these to be covered by us.

Nothing in these terms limits your statutory rights in relation to faulty or non-conforming goods.

The consumer has a period of two years from delivery of the goods in which to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.

The consumer is entitled to have the goods brought into conformity by repair or replacement within 30 days of their request, without charge and without major inconvenience.

 

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of that guarantee.

If the consumer chooses replacement but the seller instead repairs the goods because replacement is impossible or disproportionately costly, the legal guarantee of conformity is renewed for a period of two years from the date on which the repaired goods are supplied.

 

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

  • the seller refuses to repair or replace the goods;

  • repair or replacement takes place more than 30 days after the consumer's request;

  • repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the installation cost of repaired or replacement goods;

  • the lack of conformity persists despite an unsuccessful attempt by the seller to bring the goods into conformity.

 

The consumer may also obtain a price reduction or terminate the contract immediately where the lack of conformity is sufficiently serious to justify doing so. The consumer is not entitled to terminate the contract where the lack of conformity is minor.

 

Any period during which the goods are immobilised for the purpose of repair or replacement suspends the remaining guarantee period until the goods are supplied in conformity.

 

The legal guarantee of conformity applies independently of any commercial guarantee that may also be provided.

 

Consumers also benefit from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. This guarantee may be invoked within two years from discovery of the defect. Where the legal conditions are met, the consumer may obtain a reduction in the purchase price or a full refund in return for the goods.

 

Legal guarantee — digital content

 

For digital content supplied on a one-off basis, such as a downloadable digital image, the consumer has a period of two years from the date the digital content is supplied in which to invoke the legal guarantee of conformity if a lack of conformity appears.

 

During a period of one year from the date on which the digital content is supplied, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.

 

The consumer is entitled to have the digital content brought into conformity without undue delay, without charge and without major inconvenience.

Where bringing the digital content into conformity is impossible or would impose disproportionate costs, the consumer may be entitled to a reduction in price or to terminate the contract.

 

The consumer may also be entitled to a price reduction or to terminate the contract where the lack of conformity is sufficiently serious, where the professional refuses to bring the digital content into conformity, where conformity is unjustifiably delayed or causes major inconvenience, or where it is clear that conformity will not be achieved within a reasonable time or without major inconvenience.

 

Where the contract is terminated in accordance with the legal guarantee, the professional will reimburse the consumer in accordance with the applicable legal requirements.

 

The legal guarantee of conformity applies independently of any commercial guarantee that may also be provided.

 

Consumers also benefit from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. This guarantee may be invoked within two years from discovery of the defect. Where the legal conditions are met, the consumer may obtain a reduction in price or a full refund.

Governing law

 

These terms and contracts concluded through the Andy Jenner Studio online shop are governed by French law.

 

If you are a consumer resident outside France, this choice of law does not deprive you of any mandatory consumer protections that apply to you under applicable law.
